Conditions
Deposit We require a $400 booking deposit to
secure your reservation. This deposit will also act as your
security damage deposit. Your security deposit will be
refunded pending any loss or damages to the rental property or
other violations. Any violations of the rental agreement
and/or booking conditions may result in loss of the security
damage deposit and in some cases may terminate the rental
agreement and result in eviction.
Final
Payment Once the booking is received and accepted, payment of the balance of rent
is required 30
days before the start of the tenancy. Non-payment by the due
date will be treated as a cancellation and a cancellation
charge will be payable as listed below under Cancellation.
Changing a Booking The holiday dates may be
changed providing the cottage is available for the new dates.
Cancellation In the event of a cancellation
by the Applicants, the refund amount will include all monies
except the initial deposit of $500 as long as the cancellation
date is 30 days prior to the agreed rental date.
Price Changes The Owner reserve the right
to amend prices quoted on the Web site due to errors or
omissions.
Method of Payment Payments may
be made by cheque, email deposit (add $2.50 for each deposit) or money order. If a booking is
made within 14 days of the start of the rental period, a
certified cheque is acceptable. Any charges raised against the
Owner by their bank for handling dishonoured cheques, or bank
transfers will be passed on to the Applicants and due within 7
days of receipt of notification.
Tenants' Obligations The Tenants agree:
1. To pay for telephone charges incurred during a
tenancy. 2. To pay for any losses or damages to the
property, caused by the Tenant or a member of their party
(reasonable wear and tear excluded), 3. To take good care
of the property and leave it in a clean and tidy condition at
the end of the tenancy. 4. To permit the Owner reasonable
access to the property. 5. Not to part with possession of
the property, or share it, except with members of the party
shown on the booking form. 6. Not to exceed the total
number of people stipulated in the property description. A cot
may only be occupied by a child aged 24 months or less. 7.
Not to cause an annoyance or become a nuisance to occupants of
adjoining premises.
Duration and Times of Letting
Lettings are for a maximum of four weeks and commence
at 4.00 pm on the first day of the tenancy and end at 12.00 pm
on the day of departure unless otherwise notified. The period
booked cannot be exceeded without written
approval. The Tenants will be liable for any cost of
whatsoever nature incurred because of an unauthorised
extension.
Maximum Occupancy There is a
maximum occupancy of 8 persons for overnight accommodation, and
only the people listed in the rental contract are permitted
for overnight accommodation.
Non-availability of
Property If for any reason beyond the Owner control
the property is not available on the date booked (owing to
fire damage for example), or the property is unsuitable for
holiday letting, all rent and charges paid in advance by the
Applicants will be refunded in full, but the Applicants shall
have no further claim against the Owner.
Liability The Owner does not accept
liability for any act, neglect or default on the part of the
Owner or any other person not within their employ or
otherwise under their control, nor for any accident, damage,
loss, injury, expense or inconvenience, whether to person or
property, which the Tenants or any other person may suffer or
incur arising out of, or in any way connected with the rental.
In addition, the Owner accepts no liability for loss of or
damage to the Tenants' possessions on the Owner's property or
land.
Complaints All complaints must be
notified to the Owner immediately so that an on-the-spot
investigation can be made if necessary and remedial action
taken if required. In no circumstances will compensation be
made for complaints raised after the tenancy has ended when
the Tenant has denied the Owner the opportunity
of investigating the complaint and endeavouring to put matters
right during the tenancy.
Pets Pets may be
permitted at the discretion of the Owner. Any damage
caused by pets will be the sole responsibility of the
Applicants. The cost of repair and/or cleanup will be deducted
from the security deposit
Smoking Smoking is not permitted inside at
all. Please smoke outside and do not deposit cigarette butts
anywhere on the property as the wildlife is sensitive.
Noise Restriction No excessive noise during
the day, and a noise restriction after 11.00 pm is in effect
to respect other cottagers.
Inventory Where
an inventory is provided, any discrepancies are to be reported
to the Owner within 24 hours of arrival,
otherwise the inventory will be deemed to be correct.
Linen Linens are NOT provided (bed sheets or
towels). Comforters
and pillows are provided.
Garbage Disposal The Applicants
must remove all garbage from the premises upon departure.
Instructions and directions will be provided on where garbage
can be disposed of. Recycling is mandatory.
Breach of Contract If
there is a breach of any of these conditions by any of the
Tenants, the Owner reserve the right to
re-enter the property and terminate the tenancy without
prejudice to the other rights and remedies of the Owner.
Discrepancies In case of a discrepancy
between these booking conditions and the other contents of the
Web site, these conditions shall prevail.
Validity
Clause If any term or provision in these Booking
Conditions shall in whole or in part be held to any extent to
be illegal or unenforceable under any enactment or rule of law
that term or provision or part shall to that extent be deemed
not to form part of this agreement and the enforceability of
the remainder of this agreement shall not be affected.
